Terms & Conditions
1. APPLICATION
1.1 The following Terms & Conditions (hereafter: "Terms") apply to all offers, contracts and other agreements entered into between Kate Kerdi Interiors and the Client.
1.2 Any terms and conditions of the Client shall not apply unless expressly agreed in writing by Kate Kerdi Interiors.
2. PROPOSAL
2.1 A written proposal for the project is prepared free of charge.
2.2 The proposal will include a description of the project, the scope of work, expected deliverables and design process.
2.3 A proposal issued by Kate Kerdi Interiors is valid for fourteen (14) days from the date of issue.
3. CONTRACT
3.1 The contract refers to the scope of work and deliverables described in the accepted proposal.
3.2 If the content, scope or desired result of the assignment changes during the design process, an additional agreement shall be made or the existing assignment may be terminated, after which a new proposal will be issued.
4. PROJECT EXECUTION
4.1 If the Client requests changes that deviate materially from the approved creative brief or agreed scope of work, such changes shall be treated as additional work and charged accordingly.
4.2 The Client agrees to provide feedback, approvals and requested information within a reasonable time frame, typically five (5) working days.
4.3 If any required client deliverable, including approvals, information, site access or payment, is delayed by more than seven (7) working days, the project will automatically be placed on hold. Once all outstanding items have been received, the project will be rescheduled according to Kate Kerdi Interiors' current workload and availability. Kate Kerdi Interiors shall not be liable for any resulting delays.
4.4 If any deliverable does not correspond to the agreed scope of work, the Client shall notify Kate Kerdi Interiors in writing within fourteen (14) days of final delivery.
4.5 Any claims or requested changes reported after this period shall be treated as additional work and charged accordingly.
4.6 Any revisions exceeding those included in the agreed package, or any changes requested after approval of a design stage, shall be treated as additional work and charged at the applicable hourly rate.
5. INTELLECTUAL PROPERTY
5.1 Kate Kerdi Interiors retains all intellectual property rights, including copyright, to all concepts, drawings, visualizations, specifications and other creative works produced during the project.
5.2 The Client receives a non-exclusive licence to use the design solely for the agreed project. No drawings, concepts, visualizations or design elements may be reproduced, modified, shared with third parties for other projects or used commercially without prior written consent from Kate Kerdi Interiors.
6. PAYMENT & PROCUREM
6.1 Invoices issued by Kate Kerdi Interiors shall be paid within seven (7) working days.
6.2 If payment is not received within the stated period, Kate Kerdi Interiors reserves the right to suspend all work, deliveries, procurement activities and project coordination until all outstanding invoices have been paid in full.
6.3 To confirm acceptance of the proposal, the Client shall pay the non-refundable fee specified in the design proposal.
6.4 The remaining balance of the design fee shall be invoiced in pre-agreed stages as the design work progresses.
6.5 Payment for furniture, materials, accessories or other items relating to the agreed design scheme shall be invoiced prior to orders being placed. No orders will be placed until payment has been received in full.
6.6 Final designs and deliverables will be released only after all outstanding payments have been received.
6.7 Any work extending beyond the agreed scope of services shall be charged at a rate of 50 OMR per hour unless otherwise agreed in writing.
6.8 Kate Kerdi Interiors acts as a design consultant and procurement coordinator only. Product availability, lead times and pricing are subject to change without notice and cannot be guaranteed until orders have been placed and paid in full.
6.9 Where the Client purchases products independently, Kate Kerdi Interiors is not responsible for product availability, pricing, quality, warranty, delivery, installation or compatibility of such items.
6.10 Kate Kerdi Interiors is not responsible for the quality, performance, warranty or defects of products supplied or manufactured by third parties unless explicitly supplied directly by Kate Kerdi Interiors.
7. EARLY TERMINATION
7.1 If the Client terminates the assignment before completion, the Client shall pay seventy-five percent (75%) of the total agreed design fee to compensate for design work completed, time reserved and resources allocated to the project, unless otherwise agreed in writing.
8. LIABILITY
8.1 Kate Kerdi Interiors is not liable for errors, omissions or inaccuracies in materials, measurements, information or documentation supplied by the Client or third parties.
8.2 Kate Kerdi Interiors is not responsible for construction quality, installation methods, workmanship or execution carried out by contractors, suppliers or other third parties, even where recommendations or coordination services are provided.
8.3 All dimensions, existing conditions and technical details must be verified on site by the contractor and/or supplier prior to fabrication, ordering or installation. Kate Kerdi Interiors shall not be liable for discrepancies resulting from unverified site measurements.
8.4 Kate Kerdi Interiors shall not be liable for any indirect, consequential, incidental or loss of profit damages arising from the project or the use of the design.
8.5 The total liability of Kate Kerdi Interiors, under any circumstances, shall be limited to the total design fee invoiced for the relevant project.
9. PHOTOGRAPHY
9.1 Kate Kerdi Interiors reserves the right to photograph completed projects and use such photographs for its portfolio, website, social media, publications and marketing purposes unless otherwise agreed in writing by the Client.
10. FORCE MAJEURE
10.1 Kate Kerdi Interiors shall not be liable for delays or failure to perform its obligations resulting from circumstances beyond its reasonable control, including but not limited to supplier delays, shipping disruptions, labour shortages, government restrictions, natural disasters or other force majeure events.
11. GOVERNING LAW
11.1 All agreements between Kate Kerdi Interiors and the Client shall be governed by and construed in accordance with the laws of the Sultanate of Oman.
